• 1 Scope, Definitions

(1) Ralf Schuster Technischer Handel, Elsässer Weg 22a, 45481 Mülheim an der Ruhr, Germany (hereinafter: “we” or “Ralf Schuster Technischer Handel”) operates an online shop for goods at https://www.stahltiger.info. The following terms and conditions apply to all services between us and our customers (hereinafter: “Customer” or “you”) in the version valid at the time of the order, unless expressly agreed otherwise.

(2) A “consumer” within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity. An “entrepreneur” is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction. A partnership with legal capacity is a partnership that has the capacity to acquire rights and enter into obligations.

• 2 Conclusion of Contracts, Storage of Contract Text

(1) The following provisions apply to orders placed via our online shop at https://www.stahltiger.info.

(2) Our product presentations on the Internet are non-binding and do not constitute a binding offer to conclude a contract.

(3) By placing an order via our online shop, the customer submits a binding offer to conclude a purchase contract by completing the order process. The order process includes the following steps:

1. Selecting the desired product(s),
2. Adding the products by clicking the corresponding button (e.g., “Add to cart”),
3. Reviewing the contents of the shopping cart,
4. Proceeding to checkout,
5. Entering/verifying address and contact details, selecting a payment method, confirming the terms and conditions and the cancellation policy,
6. Submitting a binding order by clicking the “Buy now” button,
7. The contract is concluded when you receive an order confirmation from us by email within three business days.

(4) In the event of the conclusion of a contract, the contract is concluded with Ralf Schuster Technischer Handel, Elsässer Weg 22a, 45481 Mülheim an der Ruhr, Germany.

(5) Before placing the order, the contract data can be printed out using the browser’s print function or electronically saved. Order processing and transmission of all necessary information in connection with the conclusion of the contract (including order data, terms, and cancellation policy) will be carried out by email, partially automated. The contract text will not be stored by us after the conclusion of the contract.

(6) Input errors can be corrected using the usual keyboard, mouse, and browser functions (e.g., the “back” button of the browser). The order process can be aborted at any time by closing the browser window.

(7) Order processing and all necessary information for the conclusion of the contract will be handled via email. You must ensure that the email address you have provided is correct and that the receipt of emails is technically possible and is not blocked by spam filters.

• 3 Subject of the Contract and Essential Product Characteristics

(1) The subject matter of the contract in our online shop is:

1. The sale of goods. Specific goods offered can be found on the respective product pages.

(2) The essential characteristics of the goods can be found in the respective product descriptions.

(3) For digital products, any restrictions visible in the product description or resulting from the circumstances apply, particularly regarding hardware and software requirements. Unless otherwise agreed, the product is intended solely for private and business use without the right to resell or sublicense.

• 4 Prices, Shipping Costs and Delivery

(1) The prices stated in our offers and any shipping costs are total prices and include all components, including all applicable taxes.

(2) Payment must be made in advance unless otherwise expressly agreed (e.g., purchase on account). The available payment methods are indicated during the order process. Unless otherwise specified, payment is due immediately.

(3) In addition to the stated prices, shipping costs may apply unless the respective item is shown as free of shipping costs. These will be clearly stated again during the ordering process.

(4) Unless otherwise stated in the product description, all offered products are ready for immediate dispatch (delivery time: 1–3 business days).

(5) Delivery is only made to the following country: Germany.

• 5 Right of Retention

(1) You may only exercise a right of retention if your claim is based on the same contractual relationship.

• 6 Right of Withdrawal

As a consumer, you have a right of withdrawal. Detailed information is provided in our withdrawal policy.

• 7 Liability

(1) Except as otherwise provided below, liability for breaches of contractual obligations and tort is limited to intent and gross negligence.

(2) We are liable without limitation in cases of slight negligence for injury to life, body, or health or for breaches of essential contractual obligations. In cases of default due to slight negligence or if performance becomes impossible, liability is limited to foreseeable, contract-typical damages. Essential contractual obligations are those obligations whose fulfillment is necessary to achieve the purpose of the contract and on whose compliance the customer regularly relies.

• 8 Contract Language

The contract language is exclusively German.

• 9 Warranty

(1) The statutory warranty rights apply.

(2) For business customers, the warranty period for delivered goods is 12 months.

(3) Consumers are requested to check the goods/digital products/services immediately upon fulfillment for completeness, obvious defects, and transport damage and to notify us and the carrier of any complaints as soon as possible. Failure to do so does not affect your statutory warranty rights.

• 10 Final Provisions

(1) German law shall apply. For consumers, this choice of law shall apply only to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

(2) The provisions of the UN Sales Convention (CISG) shall not apply.

(3) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships is the registered office of the supplier.
